The ArtByUs.com forums are privately owned and run. The webmaster reserves the right to remove / move messages at any time, if you continuously flout our rules you will be banned from posting. In posting a message you are agreeing to the rules laid out below. If you do not agree to the rules, do not post.

The forums are not actively moderated, however we do passively moderate (delete messages when rules are broken). We have a very simple, common sense and liberal set of rules which we expect every poster to follow.

Agreement

You acknowledge that any submissions you make to us (i.e., user-generated content including but not limited to: text, video, audio and photographs) (each, a "Submission") may be edited, removed, modified, published, transmitted, and displayed by ArtByUs.com and you waive any moral rights you may have in having the material altered or changed in a manner not agreeable to you.

You grant ArtByUs LLC a perpetual, nonexclusive, world-wide, royalty free, sub-licensable license to the Submissions, which includes without limitation the right for ArtByUs.com or any third party the ArtByUs LLC designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed, any Submission posted by you on or to ArtByUs.com or any other website owned by ArtByUs LLC, including any Submission posted on ArtByUs.com through a third party. 

You may participate in any forums or messaging threads offered, but you agree not to post any material the content of which (i) is defamatory, libelous, obscene, indecent, abusive, threatening to others, or in violation of any law; or (ii) infringes the copyright, trademark right, or other intellectual property right of any third party. You will be solely responsible for all content that you post on ArtByUs.com

You agree to indemnify ArtByUs LLC, its officers and employees from and against all liabilities, judgments, damages, and costs (including attorney's fees) incurred by any of them which arise out of or are related to the content that you post. Forums and messaging are intended only for the personal use of subscribers, and may not be used for commercial purposes or for organized political activity. You agree to report any copyright violations to ArtByUs.com as soon as you become aware of them.

Bannable Offenses

• Verbally abuse Direct personal insult of another member, i.e., "You are an idiot." and all the variations.
• Spam and overposting: Not just being a prolific poster, but posting the same exact post in many different threads, posting multiple pointless posts in the same thread, making numerous post with no real content, or posting for the purpose of gaining a higher post count. This will get you banned.
• Pyramid schemes: ArtByUs.com does not condone multi-level marketing schemes. Members who post referral links to these sites will have their posts/signatures edited and may be subject to banning. New members who post solely for this purpose will be immediately banned.
• Harassment: Purposely intimidating a particular member, harassing them, sending them rude or unwanted private messages, etc. This includes personal attacks on moderators for doing their jobs.
• Advertising/soliciting: Using the forums for advertising or for commercial business deals and offers. Threads started for the purpose of advertising products, services, or businesses, building traffic at other websites, soliciting donations or contest entries, offering jobs, etc. will be deleted. Memberships created solely for such purposes will be banned.
• Profanity: Posting of any messages that are obscene, vulgar, sexually-oriented, hateful, threatening, or otherwise violative of any laws.
• Multiple registration: You may register only one account, and if you were banned, you may not reregister. Reinstatement can come only from arn or an administrator.
• Shared accounts: Accounts are to be used by only one person, and not shared between family members, friends or any other people. Registration is free, so there is no reason not to create a unique account for each person.
  

This Agreement has been made in and shall be construed and enforced in accordance with South Carolina law. Any action to enforce this agreement shall be brought in the federal or state courts located in Anderson, SC.
